By accessing or using the WoWPixel website and services ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of the terms, you may not access or use the Service.
WoWPixel provides an online platform for AI-powered image editing, including but not limited to background removal, image upscaling, filtering, and other image manipulation tools. The Service is available through a credit-based system for premium features.
To access certain features, you must create an account. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You retain all rights to the images and content you upload to the Service ("User Content"). By uploading User Content, you grant WoWPixel a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content solely for the purpose of providing the Service to you. You are solely responsible for your User Content and the consequences of uploading and processing it. You represent and warrant that you have all necessary rights to your User Content and that its use in connection with the Service does not violate any applicable law or infringe upon the rights of any third party.

Certain features of the Service are available for purchase via a credit system. All payments are processed through our third-party payment processor (Stripe). By making a purchase, you agree to their terms of service. Purchased credits do not expire while the Service is available. All purchases are final and non-refundable except as required by law. Free or promotional credits, including the credits granted on signup, have no cash value and are not refundable. Where a refund is issued, it is calculated on purchased credits only.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WOWPIXEL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL WOWPIXEL, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
You agree to defend, indemnify and hold harmless WoWPixel and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the company is based, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
